On August 31, 2026, the European Commission designated ChatGPT a "Very Large Online Search Engine" (VLOSE) under the Digital Services Act (DSA). Reddit and Roblox were designated the same day, under different categories. ChatGPT is the first AI chatbot to receive this classification.
The designation runs on a number. The DSA classifies any service with more than 45 million average monthly EU users as "very large." OpenAI reported ChatGPT's EU average monthly users at roughly 159.1 million — more than three times the threshold. The Commission called ChatGPT a "hybrid service" because it searches the web while answering questions, and ruled that this search behavior meets the bar for a search engine.
Until now, this was Google and Bing's category alone
The DSA's "Very Large Online Search Engine" category was built for services that show a traditional results page — Google Search, Bing. Carrying that label means publishing how your ranking algorithm works, giving users a non-personalized results option, submitting to annual independent audits, and sharing data with regulators and researchers. Targeted ads to minors are banned, and so is ad targeting based on sexual orientation, religion, ethnicity, or political beliefs.
ChatGPT doesn't show a results page. It answers in sentences, searching the web behind the scenes when it needs to. The EU treated that background search itself as "search." OpenAI has until January 2027 — four months from notification — to meet these obligations.
The reading: scale triggers regulation, not the name you gave yourself
Nobody at OpenAI ever called ChatGPT a "search engine." EU regulators didn't care about the label — they looked at what it actually does and how many people use it. Cross 45 million users, and search-engine-grade obligations attach automatically, whatever the service calls itself. The industry has used the term "GEO" (generative engine optimization) for a few years now as informal shorthand; this designation is the first time "being cited by ChatGPT is a form of being found in search" got an actual legal definition behind it.
What's certain and what isn't — Certain, confirmed by the European Commission's own announcement: the August 31 designation, the three services named (ChatGPT, Reddit, Roblox), the numbers behind it (roughly 159.1 million EU average monthly users against a 45 million threshold), the obligations (risk assessment, transparency reporting, annual audits, a non-personalized option), and the compliance deadline (January 2027). Not yet known: whether this regulation will actually change which sites ChatGPT cites, or how. The compliance deadline is four months out, so nothing about how ChatGPT answers or attributes sources changes today (as of this September 4, 2026 check).
